If you are using FacilityMate on behalf of an organization (e.g., your employer), you acknowledge that your organization may have a separate agreement with us (a "Master Services Agreement") that may supersede certain aspects of this policy regarding data ownership.

2. Definitions

To help strictly define our relationship with your data:

  • "Customer" refers to the organization or entity that has subscribed to the FacilityMate SaaS platform.
  • "End User" refers to the individual employee, contractor, or agent authorized by the Customer to use the Services.
  • "Customer Data" refers to the electronic data, files, and maintenance logs submitted to the Services by the Customer or End Users.

3. Information We Collect

We collect information in three ways: (a) Information you provide directly, (b) Information collected automatically, and (c) Information from third-party sources.

A. Information You Provide

  • Account & Registration Data: Name, email address, phone number, company name, job title, and encrypted login credentials.
  • Transaction Information: We collect details related to your use of our Services, such as check-in and check-out times at facilities, the type of service requested, diagnostic notes, time spent on tasks, and ratings/feedback provided.
  • Billing Information: If you are the account administrator paying for the SaaS subscription, our third-party payment processors (e.g., Stripe) collect your credit card details and billing address. We do not store full credit card numbers on our servers.
  • Customer Support Data: Information sent when you open a support ticket or contact us for help.

B. Customer Data (Service & Operational Data)

In the course of using the SaaS platform, you may upload:

  • Maintenance Records: Work orders, incident reports, asset histories, and compliance logs.
  • Media & Files: Photos of facility conditions, blueprints, invoices, and other documents.
  • Background Check Information (If Applicable): If a Customer uses the Services to track technician vetting, they may upload data related to background checks.

Note: The Customer is solely responsible for obtaining necessary consents and complying with the Fair Credit Reporting Act (FCRA) and other applicable laws when collecting this data.

C. Information Collected Automatically

  • Device & Technical Data: IP address, device model, operating system, browser type, unique device identifiers (UDID), and crash logs.
  • Usage Data: Clickstreams, access times, pages viewed, and feature usage patterns to help us analyze platform performance.
  • Location Data:
    • Precise Location: With your explicit consent via your mobile operating system's permission system, we collect precise location data to verify presence at a job site (Geofencing) or tag a service request.
    • Background Location: If you enable "Always Allow" location permissions, we may collect location data even when the app is in the background to automate check-ins/check-outs. You can change this to "While Using the App" at any time in your device settings.

D. Cookies and Tracking Technologies

We use cookies, pixels, and local storage to provide and improve our Services. Our use falls into the following categories:

  • Strictly Necessary Cookies: Essential for the website to function (e.g., logging in, security). These cannot be switched off.
  • Performance Cookies: Allow us to count visits and traffic sources to measure and improve performance. All information is aggregated and anonymous.
  • Functionality Cookies: Enable enhanced functionality and personalization (e.g., remembering your language or region).
  • Targeting Cookies: May be set by our advertising partners to build a profile of your interests and show you relevant ads on other sites.

Do Not Track Signals: We do not currently respond to web browser "Do Not Track" (DNT) signals or similar mechanisms.

As a Data Controller (For Account & Billing Data):

  • To communicate with you regarding updates, security alerts, and administrative messages.

As a Data Processor (For Customer Data):

  • To provide the functionality of the FacilityMate platform (e.g., dispatching work orders, tracking asset history).
  • To process maintenance reports and analytics on behalf of the Customer.
  • To provide technical support and troubleshoot issues at the Customer's request.

5. How We Share Information

We do not sell your personal data in the traditional sense. We disclose information only in the following circumstances:

  • Service Providers (Sub-Processors): We engage third-party companies to assist in operating the Services (e.g., cloud hosting providers like AWS/Azure, email delivery services, analytics providers, and payment processors). These parties have access to your data only to perform specific tasks on our behalf and are obligated to protect it.
  • The Customer (Your Employer): If you are an End User, the Customer (e.g., your facility manager or employer) has access to your usage data, location logs (if enabled), and work history within the platform.
  • Legal Compliance: We may disclose information if required by law, subpoena, or valid legal process, or to protect the rights, property, or safety of WUV Inc., our users, or others.
  • Business Transfers: In the event of a merger, acquisition, generic reorganization, or sale of assets, your data may be transferred as part of the transaction.

6. Data Retention

  • Account Data: Retained for as long as your account is active and for a period thereafter as necessary to comply with legal/tax obligations.
  • Customer Data: Retained in accordance with the Customer's instructions and the terms of our Master Services Agreement.
  • Post-Termination: Upon termination of a subscription, data is typically retained for a grace period (e.g., 60 days) to allow for export. After this period, data is securely deleted or anonymized, unless a longer retention period is required by law.

7. Security

We employ industry-standard organizational and technical safeguards to protect your data, including:

  • Encryption: Data is encrypted in transit (TLS/SSL) and at rest (AES standards).
  • Access Controls: Strict role-based access control (RBAC) ensures only authorized personnel can access data.
  • Monitoring: Regular security audits and infrastructure monitoring.

While we strive to use commercially acceptable means to protect your data, no SaaS platform is 100% immune to security risks.

8. International Data Transfers

FacilityMate is operated by WUV Inc. in the United States. If you are accessing the Services from outside the U.S., please be aware that your information may be transferred to, stored, and processed in the United States.

We rely on appropriate legal mechanisms, such as Standard Contractual Clauses (SCCs), to ensure data protection during international transfers.

9. Your Rights and Choices

For End Users (Employees)

If you are using FacilityMate through an employer (the "Customer"), the Customer is the "Data Controller" of your data. To request access, correction, or deletion of your work logs or profile, please contact your employer/administrator directly. WUV Inc. cannot delete Customer Data without the Customer¡¯s authorization.

For Direct Users & Administrators

Depending on your jurisdiction, you may have rights to:

  • Access the personal data we hold about you.
  • Request correction of inaccurate data.
  • Request deletion of your account (subject to data retention for tax/legal reasons).
  • Opt-out of marketing communications.

10. US State Privacy Rights (California, Virginia, Colorado, etc.)

If you are a resident of California or other states with specific privacy laws (e.g., CCPA/CPRA, VCDPA, CPA), you have specific rights regarding your personal information.

  • Right to Delete: You may request the deletion of your personal information, subject to certain exceptions.
  • No Sale of Personal Data: We do not "sell" your personal information for money. However, under California law, "sharing" data for targeted advertising may be considered a "sale." You may opt-out of this sharing by adjusting your cookie preferences or contacting us.
  • Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

11. Children¡¯s Privacy

FacilityMate is a B2B enterprise tool and is not intended for individuals under the age of 18. We do not knowingly collect personal information from children.
